1. Acceptance of Terms
These Terms & Conditions ("Terms") form a legally binding agreement between you ("User", "you") and Talanta Network ("we", "us", "our"). If you do not agree with any part of these Terms, you must not create an account, vote, nominate, or use the platform.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to register or participate. Nominees must be legally allowed to perform in Kenya and must submit accurate personal information. Talanta Network reserves the right to refuse, suspend, or terminate any account at its sole discretion.
3. Accounts & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Provide accurate information. Impersonation, fraud, or use of another person's identity is strictly prohibited and may result in permanent removal without notice.
4. Nominations
By submitting a nomination (yourself or on behalf of another person), you confirm that all information is true and that you own or have permission to use any photos, videos, or content uploaded. You grant Talanta Network a worldwide, royalty-free, non-exclusive license to use, display, broadcast, reproduce, and promote your submitted content for purposes related to the competition, marketing, and media coverage, across all channels and formats, in perpetuity.
5. Voting & Payments (Non-Refundable)
Public voting is powered by M-Pesa at KSh 10 per vote. By making a payment you acknowledge and agree that:
- All payments are FINAL and NON-REFUNDABLE under any circumstance, including but not limited to a nominee being eliminated, disqualified, withdrawing, or losing.
- Votes carry no monetary value and cannot be exchanged, transferred, resold, or redeemed for cash.
- You are solely responsible for verifying the nominee and amount before confirming payment.
- Talanta Network is not liable for M-Pesa network delays, failed transactions, wrong PINs, or any charges levied by Safaricom.
- In the event of a duplicate charge caused by a verified system error, our sole obligation is to credit the missing votes — no cash refund will be issued.
- Any attempt to reverse, chargeback, or dispute a completed M-Pesa payment may result in permanent account suspension.
6. Judging & Results
Judging is carried out by an independent panel using our published scoring model (Judges + Host Panel 50%, Paid Votes 50%). Scores, verdicts, and final results are at the sole discretion of Talanta Network and the appointed judges, and are FINAL and BINDING. No appeals will be entertained.
7. Prizes, Sponsorships & Opportunities
Any prizes, sponsorships, brand deals, or opportunities offered are subject to availability and to separate terms provided by the relevant sponsor or partner. Talanta Network makes no guarantee of monetary reward or contract outcome and shall not be held liable for any sponsor's failure to deliver.
8. User Conduct
You agree not to: (a) upload unlawful, defamatory, obscene, hateful, or infringing content; (b) attempt to manipulate votes through bots, scripts, or fraudulent M-Pesa transactions; (c) harass judges, staff, or other users; (d) attempt to hack, reverse-engineer, or disrupt the platform. Violations may lead to disqualification, account deletion, and legal action.
9. Intellectual Property
All platform content, branding, logos, code, and design are the property of Talanta Network. You may not copy, redistribute, or use them without written permission.
10. Privacy
We collect only the information necessary to run the competition (name, email, phone, county, photo, payment references). We do not sell personal data. Payment processing is handled by Safaricom M-Pesa under their own terms. By registering, you consent to receive competition-related communication.
11. Disclaimer of Warranties
The platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or that the platform will meet your expectations.
12. Limitation of Liability
To the maximum extent permitted by law, Talanta Network, its directors, employees, judges, partners, and affiliates shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit, data, goodwill, votes, or opportunity, arising out of your use of the platform. Our total aggregate liability for any claim shall not exceed KSh 1,000 or the amount you paid in the 30 days preceding the claim, whichever is lower.
13. Indemnity
You agree to indemnify and hold harmless Talanta Network against any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, your content, or your conduct on the platform.
14. Changes to the Competition
We reserve the right to modify, postpone, suspend, or cancel any round, category, county rollout, or the entire competition at any time without prior notice and without liability. Changes to scoring, timelines, or rules will be posted on the site and take effect immediately.
15. Termination
We may suspend or permanently delete your account at any time, with or without notice, for any reason including suspected fraud, breach of these Terms, or inactivity. Deleted accounts and any associated scores or content may be permanently removed.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any dispute shall first be attempted to be resolved amicably in writing. Failing that, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
